Your privacy is critically important to us. This Privacy Policy outlines how Blue Dignity ("we") collects, uses, maintains, and discloses information collected from users (each, a "User") of the https://bluedignity.org website ("Site"). This policy applies to the Site and all products and services offered by Blue Dignity.

1. Information We Collect: We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register for the newsletter, book a call, fill out a form, and in connection with other activities, services, features or resources we make available on our Site.

Personal Data:

  • Newsletter Sign-up: If you sign up for our newsletter, we collect your email address, first name, and last name.

  • Call Booking: When you book a call with our expert through the embedded calendar widget, we collect your email address, first name, and last name, along with the details of your scheduled meeting (date, time, and any notes you provide).

Non-Personal Data: We may collect non-personal identification information about Users whenever they interact with our Site. This may include the browser name, the type of computer and technical information about Users' means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Cookies: Our Site uses "cookies" to enhance User experience, for record-keeping purposes, and sometimes to track information about them. We use both essential cookies (necessary for the website to function) and non-essential cookies (for analytics, personalization, etc.). When you first visit our Site, you will be presented with a cookie consent banner allowing you to accept or decline non-essential cookies. You may also choose to set your web browser to refuse cookies, or to alert you when cookies are being sent. If you do so, note that some parts of the Site may not function properly.

2. How We Use Collected Information: Blue Dignity collects and uses User personal information for the following purposes:

  • To send periodic emails: The email address Users provide will only be used to send them information and updates pertaining to Blue Dignity, the Out of the Blue Movement, and its projects (e.g., Khoi San). It may also be used to respond to their inquiries, and/or other requests or questions. If User decides to opt-in to our mailing list, they will receive emails that may include project news, updates, related product or service information, etc.

  • To schedule and conduct meetings: The information collected when booking a call is used to facilitate the scheduled discussion with our expert regarding any of our projects, potential partnerships, or sponsorship opportunities.

  • To improve our Site: We may use feedback you provide to improve our products and services.

  • To promote our project and engage with partners/sponsors: The information helps us understand interest in our project and connect with potential collaborators and donors.

3. Legal Basis for Processing: We process your Personal Data in compliance with the conditions for lawful processing as set out in the Protection of Personal Information Act (POPIA) of South Africa, and where applicable, the General Data Protection Regulation (GDPR). Our legal bases include:

  • Consent: For sending newsletters and booking calls, we rely on your explicit consent. You have the right to withdraw your consent at any time by contacting us or using the unsubscribe link in our emails.

  • Legitimate Interests: We may process data based on our legitimate interests in promoting our project, improving our website, and engaging with potential partners and sponsors, provided these interests do not override your fundamental rights and freedoms.

How We Protect Your Information: We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

5. Sharing Your Personal Information: We do not sell, trade, or rent Users' personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third-party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or processing calendar bookings. These third parties are contractually obligated to protect your information and use it only for the purposes for which we disclose it to them.

International Data Transfers: Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction. If you are located outside South Africa and choose to provide information to us, please note that we transfer the data, including Personal Data, to South Africa and process it there. When we transfer your data to third-party service providers located outside South Africa or the European Economic Area (EEA), we ensure appropriate safeguards are in place, such as Standard Contractual Clauses approved by the European Commission or other legally recognized mechanisms, to protect your data.

6. Data Retention: We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy, or as required by law. For newsletter subscribers, we retain your data until you unsubscribe. For call bookings, we retain the data for a reasonable period necessary to manage the interaction and follow-up.

  • The right to restrict processing – You have the right to request that we restrict the processing of your Personal Data, under certain conditions.

  • The right to object to processing – You have the right to object to our processing of your Personal Data, under certain conditions.

  • The right to data portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

  • The right to withdraw consent – Where we rely on your consent to process your Personal Data, you have the right to withdraw that consent at any time.

  • The right to lodge a complaint – You have the right to lodge a complaint with a supervisory authority if you believe your data protection rights have been violated.

We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
